La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
Se dirimió el asunto con la remisión del expediente al Juzgado 5 Penal Municipal con función de Garantías de Pereira para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el Auto del 26 de febrero de 2025, proferido por el Juzgado 005 Penal Municipal con función de Garantías de Pereira, dentro del trámite de la acción de tutela promovida por la señora Carolina.
- SEGUNDO. REMITIR el expediente ICC-4934 al Juzgado 005 Penal Municipal con función de Garantías de Pereira para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.
- TERCERO. Por la Secretaría General de esta corporación, COMUNICAR la presente decisión a la parte demandante y a los Juzgados 002 Administrativo de Oralidad de Cali, 005 Laboral del Circuito de Manizales, y 005 Penal Municipal con función de Garantías de Pereira.
